Terms and Conditions of Booking

Elbaz Tours we acts as the organizer of travel arrangements. By booking a tour, trek, day trip, or any related service with us, you agree to these Terms and Conditions on behalf of yourself and all persons named in the booking.

1. Booking and Contract

 

 

1.1 Booking Confirmation

 

  1. Contract Formation: A contract is formed between the Client and Elbaz Tours once we receive the required initial deposit and issue a written Booking Confirmation invoice via email.

  2. Lead Client: The person making the booking (the Lead Client) accepts these conditions for all persons named in the booking and is responsible for all payments due.

 

1.2 Deposit and Payment Schedule

 

  1. Deposit: To secure any private multi-day tour or custom package, a non-refundable deposit of 25% to 30% of the total tour price is required upon booking confirmation. (Specify your exact deposit amount here).

  2. Day Trips: Full payment (100%) is required for all day trips, excursions, and single-activity bookings at the time of reservation.

  3. Balance Payment: The remaining balance (70% to 75%) must be paid no later than 30 days prior to the confirmed start date of the tour, unless explicitly agreed otherwise in writing (e.g., balance paid upon arrival in cash).

  4. Late Bookings: For bookings made within 30 days of the start date, the full amount (100%) is due immediately to secure the reservation.

  5. Failure to Pay: If the balance is not received by the due date, we reserve the right to cancel the booking and retain the non-refundable deposit.

 

2. Prices, Inclusions, and Exclusions

 

 

2.1 Prices

 

  1. All prices quoted are in Euros (€) unless otherwise specified.

  2. We reserve the right to change prices due to significant increases in transportation costs (e.g., fuel), government taxes, or fees, up to 20 days before departure. We will not pass on any price increase that is less than 5% of the total tour price.

 

2.2 Inclusions (Standard)

 

Unless otherwise specified in your itinerary, tour prices typically include:

  • All accommodations (Riads, hotels, desert camps) as listed in the itinerary.

  • Ground transportation in a private, air-conditioned vehicle with a dedicated driver.

  • The services of a dedicated English-speaking local guide/driver (and specialized local city guides where required by Moroccan law).

  • Meals as explicitly indicated in the itinerary (e.g., B=Breakfast, L=Lunch, D=Dinner).

 

2.3 Exclusions (Standard)

 

Prices typically exclude:

  • International flights to and from Morocco.

  • Travel and medical insurance (mandatory, see Section 7).

  • Visa fees, passport costs, and excess baggage charges.

  • Optional activities, personal expenses (laundry, drinks, souvenirs), and tips for guides/drivers.

 

3. Client Cancellation and Refunds

 

All cancellations must be received by Elbaz Tours in writing (via email from the Lead Client). Cancellation charges are calculated from the date we receive the written notification:

  • No Refund will be given for services that are unused, partially used, or if a Client leaves a tour voluntarily after the commencement date.

 

4. Amendments by the Client

 

  1. Minor Changes: We will make every effort to accommodate minor changes to your booking (e.g., accommodation name, date shift) outside of 60 days without charge, but cannot guarantee this.

  2. Major Changes: Changes requested within 60 days of departure may incur an administrative fee of €[50-100] per person plus any costs imposed by our suppliers (hotels, transport).

  3. Substitution: A booking may be transferred to another person (at least 7 days before departure) provided all parties accept the transfer fee and the new Client agrees to these terms.

 

5. Amendments and Cancellation by Elbaz Tours

 

  1. Minor Changes: We reserve the right to make minor changes to the itinerary (e.g., switching Riads of similar category, slight change in timing) when necessary.

  2. Significant Changes: If we are forced to make a significant change to an essential part of your booking, we will inform you as soon as possible. You will have the choice to:

    • Accept the revised arrangements.

    • Book an alternative tour of comparable standard (paying or receiving a refund for any price difference).

    • Cancel and receive a full refund of all monies paid to us.

 

6. Force Majeure

 

We are not liable for any injury, loss, damage, expense, or compensation if we are prevented from performing our contractual obligations due to Force Majeure. This includes any event that we or the supplier could not, even with all due care, foresee or avoid, such as: war, threat of war, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions, epidemic, or closure of airports/roads.

 

7. Travel Documentation, Health, and Insurance

 

  1. Passports and Visas: The Client is solely responsible for obtaining and possessing a valid passport, visa, and any other travel documents required for entry into Morocco. Passports must typically be valid for at least six (6) months beyond the date of return.

  2. Health: You must notify us of any medical condition, disability, or dietary requirement that may affect your ability to participate in the tour at the time of booking.

  3. Travel Insurance (Mandatory): It is a mandatory condition of booking that you purchase comprehensive travel insurance covering: medical expenses, personal accident, emergency evacuation/repatriation, personal liability, and trip cancellation/curtailment. We will request proof of insurance prior to departure.

 

8. Client Responsibilities

 

  1. Conduct: The Client must comply with all local laws, customs, and the instructions of the guide/driver. If a Client’s behavior causes distress, damage, or danger to any third party or is in breach of local law, we reserve the right to terminate the tour immediately without refund or liability.

  2. Loss/Damage: The Client is liable for any damage or loss caused by them to accommodation, vehicles, or any third-party property.

 

9. Complaints

 

  1. If you have a complaint concerning any service provided by us or our suppliers, you must inform the driver or guide immediately so that the matter can be rectified promptly.

  2. If the issue cannot be resolved locally, you must notify Elbaz Tours in writing (via email) within 14 days of the end of your tour, providing all relevant details. Failure to follow this procedure may limit or extinguish your rights to claim compensation.

 

10. Governing Law and Jurisdiction

 

This contract and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the Laws of Morocco. The parties agree to submit to the exclusive jurisdiction of the Courts of Marrakech, Morocco.
